I am less concerned about the existence of a conflict of interest than its appropriate disclosure. My conundrum? If I publish a column on the Web that fully discloses my firm relationship, is this a "solicitation" under the Investment Advisors Act of 1940 and current state Blue Sky rules. If such a column is tantamount to an advertisement or solicitation, then the column would have to be reviewed by my in-house counsel/compliance officer (among other constraints). My reaction to this? Well, with all due respect to the lawyers participating in this Forum, if we really wanted to screw Saddam we should drop said legal professionals on him rather than missles. Why? Here's a good example. Several months back a gentleman from SI asked me to write a piece about Qualcomm. Since this missive was more detailed and formal than my participation here, I ran it by in-house counsel. Three days latter the darn copy was near unrecognizable and I had wasted several hours debating phraseology with someone who doesn't know the difference between spread spectrum and spreadable fruit preserves. Oh well..
