Americans think that the 1st Amendment gives you the right to say anything you want to. When you give a recommendation you fraudulently misrepresent yourself as a financial expert. CFAs or Certified Financial Analysts are allowed to give opinions on a stock. You notice that Brokerage Houses give "Coverage" on a company and opinions that a stock is a "hold", "buy", "strong buy" etc. etc.. They employ qualified analysts who have the legal right to issue an publish these opinions.

You can give your opinion in private, but, I believe that you may be exposing yourself to a risk of a lawsuite, if the person you gave the opinion to loses his shirt.

When you post something on the internet, I believe that it is considered to be published. The SEC and some companies are just beginning to go after touters (not only because they are publishing false or misleading information).

Anyways, I'd be careful in what I'd say in these forums.
