Regarding libel suits -- a few pointers

(I'm not a lawyer, but as a journalist I deal with this every day)

1. You are NOT anonymous. Obviously Yahoo rolled over as soon as they got a subpoena and gave up the name of the poster. AOL did the same thing to that gay Navy guy a while back. And I have no doubt that SI would not make any effort to protect the identity of posters should they received a subpoena. So -- you ARE responsible for what you say.

2. In general, they can't hurt you for expressing your OPINION. It's a free country after all. They CAN collect damages if you state false and damaging FACTS. Opinion: "I think Johnny Hypster is a crook." Fact: "Johnny Hypster is a crook." Hypster might collect in court for the second statement, not for the first. Just keep putting "IMO" (In My Opinion) in every sentence.

3. Truth is still a defense. If you can prove at court that Johnny Hypster IS a crook, he can't collect. So -- accuracy, accuracy, accuracy! "According to an SEC press release dated Nov. 12 last year Johnny Hypster was convicted on 18 counts of securities fraud ... "

Fawn, most all brokerages will let you short anything intraday, you just have to cover by the end of the day. That's the only way I was able to short SKYM...sell in the morning, cover in the afternoon.
ask your broker about intraday shorting, should be no problem.
regards.
john

.I suspected that timing may be problem because when the stock starts tanking it is being shorted and all shares have been already borrowed...It means you have to be ahead of the game one step....Am I correct??

sounds right to me. I got shares from FIDO for MALL, but not SKYM (which I'd never heard of before it got mentioned here). Also got shares of KTEL before suits started, now, no way to add to the position. My advice with FIDO is, don't just walk away if no shares are offered, keep trying everyday you're still interested. Or, just be three steps ahead of the crowd '0}

Fawn, even though you realized when AAGP became overpriced, if you know about AAGP - can I mention the next AAGP - a $2 stock that can go to $25 in a hurry. Here's why.

AAGP vs. DIPL

- has anyone who likes AAGP made the comparison?

- AAGP went from 1/2 to $25

- DIPL is under $2.00; yet has 5 times the sales; is profitable; greater growth rate; etc... And its internet prospects are compelling to say the least. And both have household consumer brands. Although DIPL will do about $100 mill in sales (which is far higher).

- In fact, the internet/web action offered by DIPL can be explosive.

- I'm looking for a nice run up in Jan '99. Their web announcment last Wednesday will give customers access through Yahoo; via Catalog City, "...by the end of January 1999."

Subject 24633
- for questions & further discussion. Thanks.
