Interesting. The shorts will no doubt say this confirms their claim that ABTX out of cash and that no "deal" will occur. Longs will say AgriPro pissed about not being in the fold when the "deal" comes down. Time will tell.

LAWSUIT=BUYING OPPORTUNITY

The language extracted by Bloomberg from the filing is straight broiler-plate language from any lawsuit of this type filed in court. The matter is a non-event as regards the progress of the buy-in/buy-out and will have no impact on ABTX'S bottom line. Expenses in this regard as well as any ultimate damages(which are doubtful at best) will be covered by the errors and omissions coverage carried by the company.

Last chance to buy "the LAST PICASSO" at discounted prices. IMHO

Nice man, BTW. Short conversation and I was lucky to get through at all.

Here is what he told me:

(1) No one at ABTX, including corporate counsel or anyone at HQ knew about this before the Bloomberg
story broke

(2) ABTX management stands by the statements made in the press release concerning the reasons the deal
ran into difficulties

(3) If this matter does go to court, ABTX is certain they will prevail.
