Yes XOMA will do what they think is best for the company and for shareholders. They will also have all the facts. My concern is that circumstances can make anyone do something that is less attractive because there is no way to wait until things change to permit taking a more attractive alternative. If you need cash now you take the present value of a stream of projected sales that is probably conservative.

We don't know how much GEN pays to take it back but it might not be a great deal. Think about it, XOMA got its' milestone payment for the completion of P II. Is there a big milestone payment for not going on with P III? But if PIII works and a product can be sold then XOMA gets to decide on a payment(s) or profit sharing.
