If AOL loses its summary judgement motion a precedent is established that sets forth a series of circumstances under which AOL can be sued. This is something AOL wants to avoid at all costs. If they settle before a summary judgement ruling they avoid the risk of setting a precedent, and that precedent affects not only the BNEZ case but all the hundreds of other plaintiffs who can then get around the CDA's immunity clause. By not settling AOL is rolling the dice.
