Partial fills are a part of trading and you have to get used to them and/or figure out how to avoid them.

Your situation sounds a bit off bat because of the lack of liquidity but in a more liquid stock to avoid this (and not use the dreaded mkt order) you could raise your limit slightly above the best ask say in the situation you described to 4 11/16. You should get filled all the way to your limit ie most at 5/8 then the last 30 at 11/16.

If I get a partial fill, I will put another order in to get my fill or if it's near enough size will just leave it and trade what I have i.e I won't waste a commission for 30 shares.

The bad thing about your situation is that you should have been filled at your price. Looks like either Datek didn't represent your remaining order (most likely) or the MM just ignored it (which they are not supposed to do).
