To all:

We all know that Lev is worried about any new legal problems from the parasites. This is why we don't get any information, which creates quite a bit of frustration. But is he overdoing it?

As I recall, two years ago Congress passed legislation in an attempt to curb the frivolous Class Action suits, which was promptly vetoed by Clinton (the Trial Lawyers Association has invested a lot of money in him). Congress overrode his veto, the only one they managed to override, as I recall. This law places the burden on the plaintiff to prove that the company has deliberately conspired to defraud the shareholders, something not so easily done. However, this only applies to cases in federal courts, and the suers immediately went around it by filing their cases in state courts.

This past year, Congress closed that loophole by passing legislation requiring these types of suits to be filed in federal courts, and Clinton readily signed it (big surprise, but now he doesn't need the lawyers' money since he can't run for office again).

This is my understanding of the situation, but maybe I've missed something. Perhaps the legal beagles on the thread can help us out here. I would think the threat from the parasites would now be significantly diminished, and maybe Lev could open up at least a little and give us a meaningful progress report from time to time. What do you all think? I'd like to hear your comments.

Thanks,

- T -
