Larry, Perhaps you were not involved about 1 - 2 years ago when Valence had so much trouble with the Klockner equipment. I understand they were incapable of making it work per specifications. The way I heard it, Valence eventually gave up on help from Klockner and continued to modify the machinery themselves to get it to work as agreed. Perhaps Valence should countersue for time lost!

You could compare the situation to paying a contractor to build a house with an understanding that you don't completely pay him until the job is finished. If the roof leaks and he spends an extra six months to fix the roof and it still leaks, would you pay him in full if you had spent considerable time and expense to finish the job yourself?

Larry,

Valence may well have failed to pay Klockner some or all of the original purchase price contracted, since I was told last year that Klockner had warranted the machines to be capable of producing at least 4 mm cells per day and as originally delivered the equipment came up woefully short.
