VLAD, Certainly it is not unusual at all for a stock to beat concensus est (in this case a +0.04 vs - 0.02) without any prior warning to the earnings announcement. Happens all the time. That's why ZACK's lists the top 100 EPS surprise stocks every month. 4 trading days now and we will have a clearer picture of whether we are on the road back immediately or we have to wait longer

Short interest figures for Vivus through mid-January will be available before the CC. I feel the number will be down again, perhaps 10% to 12%. That leaves somewhere in the range of 6.5 million short shares moving towards the CC date. I believe 98Q4 will show a profit, but regardless of the status of the partnership agreement, Leland Wilson must deliver a CC presentation that will be uniformly received as credible. With a profit, and the CC goes well, short interest will actually have a reason to unwind their current strategy. This next week will be interesting. Especially Friday, I'm betting on it.
