Mitchell (or anyone), Hypothetically speaking, let's say the AOL case settles relatively soon (say sometime in February). Have you gotten any indication from Ben Ezra about how quickly they will become a fully reporting company once settlement is reached? Are they getting all the appropriate numbers ready now so that when (if) a settlement is reached they can begin reporting somewhat quickly? Or do you think they'll still hold off until the deadline set as a result of the new SEC regs? On the other hand, let's say the case doesn't settle and this thing drags on past the SEC's deadline. Do you feel that there's any way BNEZ could get some sort of exemption as a result of the case? I would think this would be unlikely. If not, how damaging do you think the release of their numbers will be case? Thanks, MXB

Mitchell: As usual, you never provide a straight answer. The reason the company won't release information on how many shares out is because of a lawsuit? Thats more transparent than you! You have been bantering about calling the company and doing your own DD, then you say the company can't release any info. Don't trip over your tongue. And id the company is selling so much product in the CompUSA and Staples channel, why do they need additional financing? So you are in touch with the CEO and CFO, just like EDII. LOL jmt
