Well, sort of/not really. It is really tough to nail someone for it. The big brokerages have the game down pat and effectively there is no restriction. In a blatant case, Jeff Vinick pulled the pump and dump on MU some years back at Fido, when he touted it in interviews while at the same time unloading it like crazy. Very easy to prove - just review the CNBS video tapes and look at the fund's trading confirmations.

He got his tit in a wringer, sort of, but I don't believe anything actually happened to him. Actually, he probably came out of it smelling like a rose. He left Fido and started his own fund and no longer worries about where his next meal is coming from, if he ever did before. -g-
