You are our resident attorney. Certainly you may not know the legalities behind such a share holders move but I know that if you are a SMART person you know who to contact or where to look up such information. I hereby nominate you Mark Stang as the Vivus share holder movement attorney. You have an inherent interest as a fellow share holder. Are you going to help us to obtain some justice?!

Hi Mark: regarding shareholder activism - has been known to be a waste of time, as well as company resources. With enough shares, the votes may be necessary to put up some Board members. Whether that results in LW being replaced is questionable. If he is being honest, then it would be hard to justify his replacement, since he appears to be looking out for the shareholders interests. This deal will NOT be easy to do. If LW were replaced in short order, it would probably delay any negotiations in progress, and negatively affect the share price.

VLAD: the biggest positive today IMHO: the CFO signed on. Unless the guy is a really good swimmer, don't think he's dumb enough to enlist on a sinking ship. The W/O's last qtr. pretty much assured some decent qtr's going fwd. Looks like he was buying time.
