All these class action lawsuits revolve around one thing...the accounting for acquisition and the pooling of R&D. I think these lawsuits are based on nothing other than the fact that these lawyers saw the words "possible restatement" thus initiating an automatic class action suit by the ambulance chasers of the business world.

I doubt they even understand this and as has been said before, PSFT is not alone in this crackdown by the SEC on acccounting for acquisitions. It's apparently become a hot button these days. But from all I've read PSFT did not do anything fraudulent or with the intent to mislead investors.

it's usual that a company whose stock price gets hammered
gets law suits like this. it's also usual that most
of law suits are finally either dismissed or settled with
some certain cash amount outside court. if psft really believe
they are innocent, they may issue a reply some time next week
saying that these law suits are no merit and hence will defend
vigorously, blu blu...
if a settlement is the final result, then
1) It could take several years to reach a result,
2) most of compensation money will go into lawyers' pcokets
instead of shareholders',
3) most of companies have insurance to cover such kind of
law suits compensation.

BTW, i was a shareholder of ifmx when it got tons of law suits
and never got a reply till now, don't know if i will eventually
get one.

Conclusion: it's your right to join but don't pay too much attention to these BS. it won't hurt PSFT.

d.

>>This letter was posted earlier on Yahoo. Can anyone give a reasonable probability that what happened to Cendent could happen to PSFT? <<

I guess you can say CD over stated past earnings so as to make it up in future earnings and PSFT understated past earnings to make higher future earnings. Guess I'll join in too, I had PSFT @ 52. Your honor, I bought PSFT cause their earnings really sucked and it was way over valued, But I had hoped they would do a CD and increase their future earnings by some other miracle. yes your honor, I always buy companies that has sky high P/E's based on my perception that the past is irrevilant. I mean your honor, How was I supposed to know their past earnings would increase with a restatement? Sorry your honor, it is all irrevilant. I just dont know how to read books.
