u said something about both sides being heard. the only thing that is being posted HERE is lies and my responses to those lies. u r attempting to make some connection between what happened before and what has happened with USAT. U RESPONDED to my question to u, but as usual, just like other bashers here, U DID NOT ANSWER it though. first off, CONNECT AMERICA ILLEGALLY OBTAINED blocks of 800 service numbers/time and resold that time to 4 to 5 other ISPs, including Franklin's FNET. Franklin might have initially been guilty of some ignorance as to making this agreement, but when upon further thought and investigation of the matter, Franklin found out that this 800 time was illegally obtained and FRANKLIN CONTACTED THE FBI CONCERNING CONNECT AMERICA. AT&T WOULD HAVE KNOWN NOTHING AT THAT POINT IN TIME IF FRANKLIN DID NOT CONTACT THE FBI and AT&T now, with USAT, we are NOT TALKING ABOUT 800 service, to begin with. we are talking about VOIP (Voice Over Internet Protocol) maybe you have heard of it? u know, its a technology that allows phone calls to be connected through the internet by compressing the voice data into packets transmitted via IP. its a technology that bypasses traditional phone lines and therefore allows phone calls occur at a fraction of the cost(simplistic definition) VOIP is legal. FRANKLIN has been written up in several industry magazines, including INTERNET TELEPHONY in which they given a BEST PRODUCT award. so, what are the similarities/differences between Connect America/FTEL and USAT/FTEL? - FTEL was a customer of Connect America USAT is a customer of FTEL - Connect America illegally obtained 800 time, misrepresented how it was obtained and resold it to FTEL. FTEL sold equipment to USAT and agreed to maintain the network for USAT. nothing was misrepresented. - Connect America broke the law by stealing 800 service time from AT&T. Franklin notified the FBI when they learned of this. Franklin was named in a lawsuit by AT&T, whose main defendant was Connect America. FTEL amicably settled with AT&T. Franklin did not directly break any law, but was accused of unjust enrichment. USAT did not break any law in running their business. it is not illegal to offer a flat rate phone service. the only thing we know is that USAT MIGHT have broken an SEC regulation, from the marketing/dissemination of public info in what the SEC suspected to inflate their stock price. USAT'S flat rate service is totally legal. the only damages that can be assessed are to USAT by their shareholders, if they broke any SEC regulations. there is NO POSSIBLE liabiltiy to Franklin through what has happened to USAT. soooo, u can say that they were similar because they both dealt in a flat rate service? WHAT A JOKE! i am willing to hear/tell both sides of a story. i JUST WONT TOLERATE LIES from you people. i WONT TOLERATE FALSE INNUENDOS either. the ONLY THING that we need to worry about concerning USAT is the possibility that we wont get any MORE business from them. it has been VERIFIED that Franklin has received 2.5 million dollars in orders from USAT and has banked the entire amount. no one can say, at this point, whether Franklin will get any more business from USAT. HOWEVER, USAT has said that they will continue building out their nationwide network. my personal opinion is that USAT's press release today was a positive for their business. to me, it tells me that USAT is divesting itself of the main problem with what caused the SEC investigation so that (IMO) they can continue with their business to the satisfaction of the SEC.
