Already well-recognized brand names, such as Liz Claiborne are suing over expropriation of brand names. "Sure you can sell our products on the web but if you want to advertise our name you'll have to sign up for a contract and pay us".

Could you elaborate a bit here? I was under the impression that the complaint referred to above was related to the following:

If someone types "Liz Claiborne" into, e.g., Excite's search engine, then Excite can display the search results accompanied by a related advertisement from one of Liz Claiborne's competitors. Isn't this the nature of that complaint? This information-entanglement aspect of the web is very interesting.
