I don't know a whole lot about technicals but we saw a 2 1/16 bottom on September 11 followed by a pop to 4 13/16 with the next bottom of 2 1/8 on October 8th. These were the two lowest bottoms since dropping to 2 yesterday. Very short term, support at about 2.5 now becomes resistance as we saw today at 2 17/32. We need to go up and stay above 2.5 to confirm that yesterday was the final shake out of weak holders. Can't ever tell with this manipulated BODV.

FWIW,

I sent an e-mail to Vivus IR yesterday with a list of about 5 questions that I thought would be important to get answers on. Today I received a reply which answered 2 of the questions:

1)The Vivus board does not have to make an immediate announcement if they choose to buy back shares.

2)The board has no plan to buy back shares presently because they need to preserve cash.

So much for Vivus buying back stock on the cheap. Perhaps if Vivus does sign a domestic partner with a large milestone they can keep it under wraps for a while and use some of the milestone cash to further reduce the float. Wishful thinking I guess but it would appear a wise strategy to buy back shares under 3 as opposed to above 15.

FWIW,

I would suggest that ALL shareholders write a letter to Leland Wilson at Vivus asking him what Vivus is presently doing to market MUSE to the PCPs and target group if a domestic partnership is not going to be finalized in the very near future. At the very least, Vivus should send out some type of flashy mailer to the PCPs designed to get their attention regarding a SAFE NON NEEDLE LOCAL ALTERNATIVE TO VIAGRA. The mailer can have Vivus' toll free support number and can offer a free starter kit for PCPs to use for initial in clinic titration.

IMHO, if Vivus is not very close to signing a domestic partner, they are way behind the curve if they don't invest at least a little $$$ to promote MUSE education.

If you are too lazy to write a letter at least send an e-mail addressed to Leland Wilson to ir@vivus.com.

Seems to me that now that Pfizer has released its multimillion Bob Dole ED awareness campaign that the LEAST Vivus can do is invest a little cash into MUSE education towards the PCP.

Do you all agree with this idea? If so please send out your letters/e-mails.
