Fact Check: The reality is that they are there only because it was a whistleblower case. 99% of the time that is how it happens. Just because the Govt has an option to stay out does not mean that they do stay out, it just does not work out that way in real practice. That minor point between the lay description page you cite to and the reality of how it works in practice does not make me an idiot, it makes me a realist.
