The reason the DOJ may not be able to settle is that a lot of states are also involved--you have to get consensus. A settlement that does not say MSFT has monopoly power is the best solution. If MSFT settles on DOJ's terms, at least the existence of a O/S monopoly in any private lawsuits has to be proven before each court. I read that if this case establishes that MSFT has a monopoly and the appeals courts uphold this view, then any private lawsuit won't require that this point be proved again--it will be accepted as already determined. To MSFT this issue is more important than tying of the O/S to the browser.
