Recent postings have encouraged BNEZ to drop the lawsuit against AOL. I disagree. I sincerely believe BNEZ was screwed and the CDA should not protect AOL.
You can blame peacelover for inspiring this response:
What does it profit you if you gain the whole world and lose your soul?
If BNEZ pursues this lawsuit to the very end and even manages to win the very best you could imagine what then? It will be a year or even two from now, most of the settlement will go to the lawyers and PMA will be long dead because BNEZ has been spending its resources of time, money and most critically stock value on the lawsuit. It would be a victory of principle only. Better to come to an agreement where everyone wins much sooner.
I agree however that the need is not instant. We might as well wait to see what the judge rules about continuing the suit. As you said BNEZ would not become instantly reporting anyway.

I hear what you are saying, but the reason I am not in favor of the lawsuit is not because of an intent to help aol. Far from it, I have lost money playing puts against it in the belief it was way overvalued much to my dismay. I don't even care for aol. I just believe from what I can find to date that bnez's leaders are not paying close attention to pma as per one of the posts which indicated that they were not even aware of product return by Compusa until after it was brought to their attention by an investor. Correct me if I am wrong. This is what bothers me about this lawsuit. Lawsuits have a knack for consuming people's energy, time and money from my personal experience. peace and good luck.
