Based on my conversation with Michael Lange, the fact Shiva issued the MOU and allowed those who voted to change their votes is the settlement for dropping the lawsuit. He told me that during discovery, the points in the MOU were discovered and thus he felt there was no case. Their fees were to be determined by the court were the suit was filed. And yes, he believed all 6 firms which sued were in agreement. The one question I didn't ask him is who decided to settle. Being a member of the suit, I was never asked anything and the only way I got info was to be persistent and call the attorney's office at BDP.
