Mr. t2k,

I though the trial was about MSFT integrating IE into Win95 in an effort to damage Netscape. That is why a preliminary junction was issued then overturned by the Appeals court.

Just before the start of the trial, the DOJ wanted the case expanded to include the monopoly allegations because they had no case based upon the appeals court ruling. I think MSFT objected to the expanded case but was overruled by the judge. MSFT then wanted a delay to prepare for the expanded trial but that to was rejected. I believe that is one of the reasons MSFT defense looks so bad. In addition, the company supposedly damaged still has the majority of market share and as of the end of March will no longer exist.

I hope you are right in that the judge will find in favor of MSFT but I doubt it. His pride was too deeply wounded by the appeals court overturning his decision.

Thank You

JK

I served as counsel to a friend in a $70k arbitration suit against a securities firm.

- I'm a CPA. Not a lawyer. And their lawyer came from a top Wall Street firm. Needless to say, I was shouted down by the lawyer & panel multiple times. My friend was going to kill me. But guess what... my friend won the case.

- So no matter how stupid MSFT looks. The Clinton Democrats have to still show how these Billion $$$ behemoths - AOL, NSCP, SUN, etc... were damaged. And I predict they're not going to be able to do it.
