I have not seen truly libelous postings on SI, but I don't doubt they could happen. Anybody who watches a thread for a while gets a feel for it and can calibrate the noise level. The negative posts I have seen here are just the kind of things I would hear in a bitch session at the local pub.

I certainly hope that this sort of legal activity does not result in the shutdown of the kinds of free expression I have seen on SI. I find it very useful to get such varied opinions, and some of the posts are very insightful (J*MAR could learn a lot--hope they are regular readers...).

I doubt that the lawsuit will go very far but I feel their pain regarding some of the Yahoo message boards. If trashing a company or individual with false information becomes a crime. Could investors who are misled by hypesters also have recourse?
