Nullsoft won't be paying it, Sam.

Asuming there's merit to PM's claim (expensive and time consuming to establish), what's likely to happen is one of the following:

1) settlement for stock and/or royalty payments

2) merger of PM and Nullsoft

3) third-party buyout of Nullsoft and settlement with PM, or even its acquisition, too

Nullsoft user base worth a fortune, Sam. This claim is pocket change even if Nullsoft doesn't have a dime. Assuming Nullsoft stole the code (and they're entitled to a vigorous defense), the expected settlement value of a $20 million claim is the bargain of the year. What's more, the publicity is free and loyal Nullsoft users see MP3 as a populist, Constitutional right. Thus, WinAMP downloads increase!

Re: BCST

Real a huge plus, no matter what its ownership.

NBC/CNET/Snap!/Cyclone and CMGI (Magnitude Network for now, but to be renamed) are enormous testaments to BCST's mission and business model. This space so vast and global, these deep-pocket competitors expand primary demand. There will be more.

BCST very secure. Nobody eats Cuban's lunch. Cuban expects 70 percent of the action to be in business-to-business, which BCST invented. Consumer content really the tip of the iceberg. BCST has a prodigious head start on the wannabees, already going global.

Ultimately, though, suggests that BCST merges with somebody, and soon. Says Cuban, "Aggregate or die." Ironically, this applies all the way up the food chain. Would love to see BCST remain independent, but it's way, way too valuable to say, YHOO, Vulcan/Charter (Paul Allen), ATHM/XCIT, AOL, WCOM, TWX blah blah. (How much? $5B+ if you hurry. Much more if you dawdle.) The list's as long as your arm. Flat portals became history in 90 days; we move to broadband and multimedia with a vengeance. Unbelievable.
