our - Of or pertaining to us; belonging to us;

sole - not divided or shared with others;

discretion - Freedom to act according to one's own judgement; unrestrained exercise of choice or will. At discretion, without conditions or stipulations.

There is nothing in the ToU that states the membership at large has any standing in interpreting said terms. However, it clearly states in numerous places that SI may exercise discretion, without limitation, in applying said terms. If they want to allow DM to post, even with the knowledge that he is in violation one or more terms, that is their choice and nobody else's.
