EBay Sued for Allegedly Infringing on Software (Update1) (Adds EBay comment in 4th paragraph.)

San Jose, March 23 (Bloomberg) -- EBay Inc., an Internet auction house, was sued by a privately
held software developer for allegedly infringing on its patented software by using a program that
lets computer users post auction listings online.

San Jose, California-based eBay is accused of using technology developed by Network
Engineering Software Inc. that allows a computer user to submit information that can then be
disseminated over a network. NES's federal suit, which was filed Tuesday in San Jose, seeks
unspecified damages and an injunction against eBay. ''We're not saying (eBay) is using the same
software per se and I don't think eBay is using the software code that NES wrote,'' said lawyer
Robert Irvine III, who represents San Jose- based NES. ''But they're using third-party software
packages that infringe on NES' patent.''

EBay spokesman Kevin Pursglove responded saying: ''While we have not yet been served with a
copy of the lawsuit, we are familiar with NES's allegations. We believe that the lawsuit is without
merit and that eBay has valid defenses to NES's claims. We intend to vigorously defend ourselves
in this matter.''

Company shares fell 8 3/4 to close at 146 3/8 today.
NYSE/AMEX delayed 20 min. NASDAQ delayed 15 min.
