I can only tell you that the government will lose this case this time, and that is all I can tell you. That is why Jackson encourage both sides to start talk during the break, hopefully a compromise can be reached. But the government did not want to lose face , so they put up a high goal on the table, and may end up with the lower ground, or lose in the court. It is the choice of the 19 states.The Judge had made it very clear.
