This is not the government getting involved in software design. This is the government enforcing existing laws as Microsoft attempts to step over them with their products.

What if I designed and marketed a dinner fork made of arsenic? Would the government shutting me down be a case of "government getting into flatware design?"

I can write a piece of software that email-bombs someone's internet account and bring them down. I've done it (not anymore of course). Are government regulations against email-bombing a case of the government getting involved in software design, mine in this case?
