The Judge (Jackson) is basically doing his best to force the Govt and MSFT to settle. He knows that MSFT is losing in the courtroom (at least in the public's eye) so doesn't really need to pressure them to settle. I believe he is using his comments regarding AOL/NSCP/SUNW to blast a shot over the bow of the DOJ and the States. This lets them know that things are not all as they may seem, and that there is still a very good chance they could lose as well.

In other words, it's a tie ball game, so go settle. And this is the only way that Judge Jackson will save face in this matter.

If and when they do settle, it won't be until late in the game, however. It's just the way these things work. Not unless MSFT gets a slow pitch over the middle of the plate, and they cannot help but to take the Govt deep!!!!
