Andreas, Sometimes I wonder who you really are? I know that you always go over the quarterly reports with a fine toothed comb. And that being said I know that you know that this same type of statement (may even be the exact same word for word statement) was mentioned in the prior Q10 and the one before that and the one before that. I believe that you have been in this game long enough to understand that this statement is just a small part of the broiler plate of Vivus' quarterly statements.
