They can always short naked,,they have the convertible debentures to cover with on convert(there is no restrictions,hell even Reg S,changed to require holders to hold for a year before converting-I can't believe there wasn't a time period restriction)..no harm,no foul..DD
PS: I think they may have had a tough time palcing these,it appears they gave away a lot in the deal,IMO
