Montal Gets To The Cert (w/ Quiel):

18 Q. So it would -- okay. I'd like to refer your attention to

19 certificate -- excuse me, to exhibit number 34. And that is a
20 copy of certificate number 2142, 4 million shares made payable
21 to the firm of J. B. Oxford.

22 A. Oh, I'm sorry. Which exhibit?

23 Q. 34.
24 A. Okay.

25 Q. Have you ever seen that document before?

QUILL - CROSS 227

1 A. Yes.
2 Q. When was that?
3 A. I don't recall exactly.
4 Q. In connection with preparing for this testimony?
5 A. Yes.
6 Q. Do you see any restrictive legends on the front or back of

7 that certificate?
8 A. No.
9 Q. Does that certificate appear to you to be in good
10 deliverable form?
11 A. It appears to be.
12 Q. If you contacted the transfer agent and called them up and
13 said, hey guys, I have certificate number 2142 of Amazon in
14 front of me. Is this valid for transfer? And they told you
15 yes go ahead and send it in, is that something that you would
16 rely on in --

17 A. No.
18 Q. -- taking that in?
19 A. No.
20 Q. And why not?
21 A. Because a certificate of this size I would call the

22 company.
23 Q. And if you had a letter from the company that said that
24 the certificates are in good form and without hold
25 restrictions would you rely on that?

ASSOCIATED REPORTERS OF NEVADA (702) 382-8778
QUILL - CROSS 228

1 A. I would still call the company.
2 Q. So you would never take in -- it's your opinion that a
3 brokerage firm should never take in a certificate of
4 approximately 4 million shares that is in good deliverable
5 form that the transfer agent has told you is valid and freely
6 transferable and you have a letter from the company that tells
7 you that there -- the certificate is valid and without hold
8 restrictions? It's your opinion that no brokerage should take
9 in that certificate without first calling the company; is that
10 right?
11 A. Yes.
12 Q. Okay. And did you follow that practice every time you
13 took in a certificate in all of your years as a broker?
14 A. No. 0nly in --

15 Q. I think you've -- you've answered the question. Thank

16 you.

23 A. I didn't give that impression.

Hey, I find Bob Quiel as impressive as all of Mikey's friends. I wonder why they didn't call John Fasano as a plaintiffs' witness?

I can certainly see why Auntie was going on at us the other night for not offering any of Bob's testimony.
