Interesting perhaps, but I'm not sure they prove anything. Now, I admit that I'm not fully conversant with the facts of the case, but from what I read it appears that Lucent ordered a Be There! system, looked at it, and decided to develop its own technology. There is nothing that I saw that indicates Lucent's technology is based upon RACE's technology. Lucent employs some of the finest minds in the business, and they may have been working on this prior to ordering the Be There system. Something may smell fishy about them ordering the system under the pretense to check its compatibility, but there is a long way to go between "something fishy" and proving patent infringement or breach of contract based on violation of a confidentiality agreement. Maybe there is more to this story, but I don't see that it is at all a "slam dunk," and I don't have time to dig into it further right now.
