X, for Mr. Hoke to be found guilty of fraud, the prosecution must show there was criminal intent. At this point in time no one with the exception of Mr. Hoke (and perhaps his co-conspirators?), knows what his intent was when he published the fake Press Release on his personal Angelfire website.

If he loaded up with stock just prior to publishing the fake PR, and then sold; or he was working in concert with other larger shareholders, then he and they might and should get nailed.

I'd like to think he wasn't that cynical.

As for those who blindly bought into the rally based on the stock's momentum - tough! (shouldn't investors spend at least a day doing due diligence before they purchase a stock?)
