Gord - Why do you think that ABZ's claims are complete garbage and WSP's are 100% true? As maintenance said so well it will all depend on which side, if either, can prove that their version of events is the factual one. Contracts are nowhere near as simple as you seem to think. Ever heard of a prenuptual agreement that was thrown out even though both parties understood what they were doing at the time it was signed? Bottom line is that if ABZ can prove that they were operating as they always had then WSP loses. If WSP can prove otherwise then WSP wins. I'm betting it's settled before they get into court and that the deal is seen as a victory for ABZ.

Gord...

No one is forced to divulgate their entire case/proof before going to court.. the papers filed are NOT a complete defense but simply proof that a court hearing is necessary to solve this problem..

Aber's argumentation is NOT completely spelled out in these pre-trail
hearings.. dont be naive : when the actual trial begins only then will we learn of Abers arguments in detail.

They will claim a gross error was comitted by an employee ( since fired) and they will win no problem.

It is against public order and good morale to strip an entity of it's proprety simply because of a gross error.
