Excuse me, Larry, but you are hyperventilating over this appeals court ruling.
The court only decided one thing: that the 1993 Forbes article did not claim a fraud at VLNC. That's all.
The significance is it's publication did not start the clock on the one year window during which a legal challenge must be made after public release of information that a fraud may have taken place. In other words, the lower court was incorrect in its judgement that the cutoff date for filing the suit was one year after publication in Forbes, which plaintiffs had missed.
That is it. It is of no significance on the merits.
