The April Fool's stock hoax and the FBI... someone asked earlier what laws, if any, the perpetrators could be accused of breaking. well, some laws that readily come to mind could be those that regulate advertising and specifically prohibit false and misleading press releases... for example, the federal trade commission act establishes that advertisements must be accurate. another federal law, the lanham act, allows an aggrieved person or business to file a lawsuit in a state or federal court based on misrepresentations directly or indirectly found in advertisements. in addition, at least 33 states across the country have laws that prohibit false and deceptive advertising... generally speaking press releases or other communications delivered to newspapers, periodicals or other news media for general information or public relations purposes are not considered to be advertisements unless a charge is made for the dissemination or use of any part of these communications. how much did you guys pay business wire to publish the phony press release anyway?... janice, jeff, bill, messing around with business wire in spite of their lawsuit against you is one thing - however unadvisable it may seem to some of us - but i'd caution you against doing the same with state and federal officials...
