Harvey, this may have been just bad management on the part of the treasury dept at qcom. Nonetheless I am going to check into the legality of this because my experience is, employees sometimes win, no matter what kind of escape hatch clause is in the options plan. But the people I know that did win were individuals that were terminated before they could vest in sizeable options, not a class action so obviously its not the same thing... still it looks like large $$ involved.
