Why should they pursue this monopolistic state when they could earn more by exchanging the access for infrastructure or commerce?
You may call it an exchange, but what it is is selling access to the wires. Everyone from the most educated professional to the newbie posting on Yahoo! can see that (even @home and the MSO's see it), and see that it is a good idea.
The real issue is coming to a fair price. So far they have not been able to agree on what access to the wires is really worth. So AOL has decided to try to get the government to regulate how much it is worth.
It all really boils down to this: Will the market or the government decide how much will be paid for access to the cable wires?
I'm currently negotiating to buy the condo I am renting. The owner thinks it is worth X, I think it is worth .9X. Maybe I should go to the government to set the price.
