I think you are correct, but I would be reluctant to counsel filing a counter-suit until I knew whether the defendants were even properly served. I think Janice lives in Italy, so she has to be served pursuant to the Hague Convention on Service of Process Abroad. And then there's venue, I don't know whether there is a waiver of venue clause in the contract.

Do you handle foreclosures? I need to sort out a question, I've got an offer pending on a house, and just saw in the legal notices that it is going to foreclosure. I could call my real estate lawyer, and ask her, but she's so danged expensive! If I ask her a simple question, she makes it into a $500 issue before I can stop her.
