it is the judge's interpretation that will determine when and if a party has overstepped their bounds in their *taking advantage*, and bending the rules.

An interesting point. Would you say that Bizwire is "taking advantage" by applying a rather personal interpretation to legal concepts like "fraud", "unfair competition", and "breach of contract"?

I don't, of course, think Kevin was "taking advantage" at all, and edited my earlier post to read "exercising".
