"It is, so far, all innuendo" . The fact is, he has not been charged with any crimes . Wen Ho Lee's Lawyer has stated in another NY Times buried deep in the back pages somewhere that all the file transfers were done according to regulations and the file names were changed according to procedures where when files have been modified they are renamed. If he is not telling the truth, the judicial system should be informed and the truth should be exposed. So far no one has rebutted the layers statement. According to the article, there appears to be some kind of anonymous leak (a special to the New York Times) that states: >>>American officials said there was evidence that the files were accessed by someone after they were placed in the unclassified network. Other evidence suggests that this was done by a person who improperly used a password, the officials said. <<< This could mean anything. Did someone actually download the data to an outside computer? The anonymous person didn't say. Did someone access one or many files and study the millions of lines of Code? The anonymous person didn't say. This is one sleazy report. Indeed, Wen Ho Lee may be a spy, just as it is possible that Bill Clinton is a spy. However, there is nothing if you really read this article that you could charge this person with a crime. This is just like in the 1950's. Senator Joseph McCarthy use to wave a piece a paper in front of cameras and proclaimed he had lists of suspected communists without any real proof to back up the ascertion. In our form of government, we cannot accuse a person of a crime unless there is evidence. Where is the evidence in this case? Witch hunts and other hate generated actions are more damaging to our form of government than any old secrets. Edward Teller, the father of the H-Bomb, recently wrote (to paraphrase his thoughts): Our society is based on openness and we manintain our liberties by staying open and keep advancing our scientific expertize . He gave examples of when the Russians in the early 1940's had to spy on the US scientific community because they could not develop the kind of science that we had in there closed society. That is the greatness of our society. We do not go on empty witch hunts to terrorize people. If the man is guilty, bring on the proof and charge the man.
