the report said before the recess the judge asked
if msft could let retailers give purchasers a choice
of browsers at time of purchase. msft said at the time
that they couldn't do this. bad news was it was against
msft...good news was remedy was fairly mild compared to
others that have been tossed around.

I am glad to read that MSFT said no. Shows some confidence and unwillingness to give up some of their bargaining position.

I think the judge has already gotten his revenge against Microsoft. After all he was nominated by the Republicans (I read it was Reagan). After he sees all the Clinton led (DOJ) effort to enforce anti-trust laws, I can see why he might might want to change his "bias" to neutral from anti-MSFT. He might be on the verge of being on the company's side. Everyone should remember that he made it difficult for the company leading up to the trial not giving much preparation time. This unpreparedness showed in the trial. In appeals, it will all come out and the MSFT will be pointing it out as part of the appeals process. That is why I believe that in his fact finding, he will signal to the DOJ/States to settle. I believe they will get his hint at that stage even though they did not before the start of the recess. I think he will not rule against the company if it gets to a judgement. We all remember how he evaluated the AOL/Netscape merger as changing the competitive landscape back in December. That shows he is looking for a way out of this one.

BTW-I don't think Clinton could care less about the anti-trust actions. He has just empowered some individuals. I hope the American Airlines lawsuit makes the DOJ want to free up some resources and cut down efforts in the MSFT case( ie settle).
