If indeed Diamond and Hercules are using the same chips, the difference may very well be in the components used and the PCB design. As frequency rises, dramatic changes occur due to the inductance and capacitance of various components. In fact, depending on the situation, various layers on your PCB itself forms a capacitor and at high frequencies the signals on one layer interfere with another.

Both diamond and hercules TNT2 Ultras ship with a fan.

I doubt it's the card layout: diamond knows what they are doing as well as hercules does. This is strictly a guess on my part: Hercules is paying more per chip for the highest clocking ones. Either Diamond was unwilling to pay or couldn't get enough quantity to meet their expected demand.
