Right on on the tax law. I'm not sure if this is FUD or not but here is a Rambus comment on delays until quarter 4.

Zeev - (...this "tax heaven" has been eliminated in the new tax code, at the end of the year you must mark your shorts to market and report the "paper income", furthermore, if one shorts against the box, the holding period on the long position is restarted from the closing of the boxed position, thus losing the "long term" status...)

This information is in part oversimplified, and in part wrong. Shorting against the box is still possible, but with severe constraints. Your tax advisor should be consulted before proceeding.
