Never underestimate the power of the community and never underestimate the wisdom of the people. It is beyond comprehension why T thinks this ruling is bad. There are so many ways for them and ATHM to profit that they wouldn't be able without it that it is testament to narrow minded greed bound management delusion.

Several analysts said they believe the ruling will be overturned. Kim Wallace, chief political strategist at Lehman Brothers Inc., said the Federal Communications Commission could join AT&T's appeal.

They can do no such thing. The FCC is going to appear in court to appeal a judge's ruling?

The FCC, which is charged with enforcing the 1996 Telecommunications Act, didn't place similar open-access conditions on the 1999 acquisition of TCI by AT&T. "It's highly unlikely that a
lower-level court judge has the same level of knowledge and expertise
about the 1996 Telecom Act" as the FCC, Supreme Court and appeals courts do, he said.


Judge Panner made a legal decision about contracts which has nothing to do with whether it has some national precedent setting status about appropriate rules of commerce. This Lehman analyst talks as though they were in the same category. He's bought the hype. Appellate court could reverse the judge's decision but only on legal grounds, not on implications of commerce grounds. T would have to sue again on different grounds if they wish to pursue that which isn't in their interest anyway. What a bunch amateurs and clowns.
