I just don't see how ATHM is the loser here. The ISP's pay the cost to entry, an ongoing fee (at a cost yet to be determined) on a network that must be underutilized at present and can be scaled in the future. My pea brain must be missing something or...?
The cost to entry would likely be split between the MSO and ATHM.
The ongoing fee goes to the MSO.
The network is not underutilized. Nowhere near, the problem is exactly the opposite.

ATHM does have the possiblity of providing a transport service between the MSO and the ISP, but that is simply a service they would offer that the ISP may or may not choose to use.

You aren't missing a thing except for the fact that open access benefits both of them far more than closed access.
