SI's disclosure policy...

Jeff,

I am extremely interested in seeing Silicon Investor's response to these recent posts:

What is your procedure for responding to a subpoena that requests information about a member? Is it really true that ..."Due to time constraints, however, SI does not always have the time to inform its members of such subpoenas.".

As this is the place to "discuss anything related to making SI a better place", I suggest that one way to improve the site is by developing, displaying and enforcing something akin to "a member's bill of rights". One of the sections should be devoted to protecting a member's privacy. I believe that SI should state that it will make every effort to inform a member of any relevant subpoenas or other legal action. If at all possible, SI should guarantee that its members will be given time to challenge a subpoena before SI feels that it must comply.

While lawyers may think that using "time constraints" as an excuse is attractive legalese, such a response is an unfortunate insult to your membership. What do time constraints really mean? Sometimes you get around to informing a members that his or her identity has been compromised and other times you don't? (!)

Let's pretend that some penny-pushing pump and dumper gets a subpoena to reveal the identities of a large number (pick an arbitrary number like 111) of members? Would you comply without informing any of the 111? Would you inform some of the 111 and then, due to time constraints, forget about the rest?

I'm sure that the increasing number of SLAPP suits and subpoenas have become headache for SI's management. But there is an opportunity here for you to set an example for other sites. Many of the subpoenas are thinly veiled acts of legal harassment: part of a plan to silence criticism of fraudulent hucksters. If you make it clear that SI will stand alongside its membership in the face of any intimidation, this site will be improved beyond any expectation.

Respectfully Yours,

"Michelino"
