David Bois, BTW, is clearly a tech neophyte. He didn't know the simplest tech concepts, like "browser", when he took the case. No wonder, it was easy to fall for the AOL sob story.

I just noticed that part of your fine post, SFD. "Neophyte" seems a bit harsh since Boies built his career on his long and successful defense of IBM in their anti-trust trial. All that I've read about him and his performance in this trial suggest that he's one of those great lawyers who is able to quickly grasp the significant points of highly technical subjects. A lawyer like that doesn't need to have a deep understanding of the subject (that's what experts, associates, and staff are for, after all), but he or she does need to be able to remember and make sense of the complex set of facts and how they relate to the case at hand.

He clearly has a great staff working for him on this trial, but Boies himself seems to spot inconsistencies quickly which is possible only if he has that kind of broad systematic understanding of what's going on.
