At this point I would say that the Thrift Application is up in smoke, if indeed it was ever intended to be filed. I can't see the OTS passing on this kind of background information. Fiduciary responsibility is a key consideration. These charters that they accept are intended exactly to serve the communities in which they are granted. So in fact I think they like to see humanitarian, philanthropic, or community service awards.

Warren David Williams and even Charlie Vaccaro were not directly related to the Thrift except by virtue of their declared membership on the Board of Directors. But there is no way that John Schmitz would not be scrutinized as I cannot see how he would have escaped being an officer of the Thrift itself. The NASDR record appears pretty damning at this point.

Further I think I can see a little more clearly why they really may have been evading the filing of their financials. This kind of thing would have to be disclosed. The SEC I doubt will look kindly on a disbarred broker floating a new company, especially in collaboration with another Registered broker as ColleenB has pointed out.

Does this make Johnny a convicted felon? I honestly don't know the legalities of this so, others......... also, considering what he was charged with, I would assume this was a criminal matter and not civil.......
